UTSTILLINGSBETINGELSER – Sjøen for alle               Norsk

1. På utstillingen kan vises

a) Båter med tilbehør.

b) Båtmotorer med utstyr, dykkeutstyr, sportsfiskeutstyr og annet utstyr for sjøsport.

c) Informasjon om maritim virksomhet, sjøferie etc.

d) Andre produkter etter særskilt godkjennelse av arrangøren.

Ikke-skandinaviske utstiller må ha en ansvarlig kontaktperson i Norge.

2. Påmeldingen er bindende. Arrangøren kan likevel, på hvilket som helst tidspunkt inntil 60 dager før utstillingen åpnes, fuavhengig av grunn og uten ansvar, forkaste hel(e) eller del(er) av bestilling(er) som er foretatt eller det er inngått avtale om, herunder forkaste eller avvise alle, eller redusere antallet, båter og/eller andre produkter og tjenester nevnt i pkt 1. Arrangøren kan også etter nevnte tidspunkt og så sent som under utstillingen, foreta nevnte endringer, mot å dekke utstillerens dokumenterte økonomiske utlegg. Arrangøren avgjør selv fritt fordelingen av utstillingsplassene. Båt(er) og/eller andre produkter som utstilles må ikke stride mot norsk lov, forskrift, herunder forskrift om produksjon og omsetning m.v. av fritids- fartøy (forskriften om CE-merking) eller rettskraftig dom.

3. Utstiller må ellers før, under og etter utstillingen nøye følge arrangørens og myndighetenes til enhver tid fastsatte direktiver og anvisninger.

4. Dersom registreringsavgiften og/eller plassavgiften ikke betales til fastsatt tid eller utstiller foretar avbestilling, er utstiller ansvarlig for å dekke registreringsavgiften og plassavgiften, med tillegg av renter og evt. omkostninger. Arrangøren er ellers i slike tilfeller berettiget til å leie bort plassen til andre uten ytterligere varsel. Dersom arrangøren får leid ut plassen til annen utstiller og utstillingen ellers blir fulltegnet, plikter utstiller kun å dekke registreringsavgiften og 50 % av plassavgiften. Arrangøren har tilbakeholdsrett i utstilte båt(er) og/eller andre produkter for ubetalt registreringsavgift eller plassavgift.

Avbestilling 14 dager før messestart er det ingen refusjon.

5. Utstillingsplassen står til disposisjon for utstiller i minst 2 dager før åpningen. Innkjøringsplanen, som blir sendt utstiller i god tid før utstillingen, må følges.

6. Utstiller må selv oppføre og innrede sin stand (utstillingsplass), besørge all transport og plikter å sørge for rydding av standen ved utstillingens slutt, alt for egen regning. Utstiller skal holde sin stand i best mulig orden og på arrangørens forlangende forbedre denne på egen bekostning, dersom arrangøren finner at den ikke er tilstrekkelig presentabel. Installasjon, tilknytning og forbruk av elektrisk strøm og telefon betales av utstiller.

7. Eventuelle skillevegger - største høyde 1,25 m. - må dekoreres på begge sider, eventuelt i samarbeid med nabostand. Dekorasjoner eller reklameplakater må heller ikke overstige 1,25 m. målt fra hallens gulv, uten skriftlig samtykke av arrangøren. Standskisse i 2 eks. må i tilfelle sendes arrangøren senest 1 måned
utstillingsåpning. For veggplasser med 3 m. dybde tillates dog sidevegger på inntil 2,5 m. høyde. Høyden på firmanavnskilt må ikke overstige 50 cm. Det kan plasseres 1 skilt mot hver publikumsgang. Underkanten av skiltet skal være 2,40 m. over hallens gulv. Mot hallens faste vegger kan det oppsettes bakvegger inntil 2,5 m. høyde. Over denne høyde er enhver bruker av hallens vegger, søyler, balustrader, etc. samt hengende reklamemateriell gjenstand for leieavgift, som fastsettes av arrangøren i hvert enkelt tilfelle og faktureres etter
utstillingen. Arrangørens tillatelse må innhentes på forhånd.

8. Stand i to etasjer som overstiger standard vegghøyde på 2,5 m. må på forhånd godkjennes av arrangøren. Standskisse må i tilfelle sendes arrangøren senest 2 måneder før utstilingens åpning. To etasjers stands, hvor første etasje har minimum takhøyde på 2 m. belastes utstiller med et tillegg på 30% av opprinnelig stand leie for aktuelt areal. Stand i to etasjer med annen etasjes gulvareal større enn 20 m2. utsløser krav om sprinkling (overrislingsanlegg), som betales av utstiller. Annen etasje med areal mindre enn 20 m2. kan på spesielle vilkår tillates uten sprinkling av første etasje. For nærmere informasjon skal arrangøren kontaktes.

Når båter utstilles, må det være passasje rundt dem på min. 1 m. unntatt de båter som er plassert ved utstillingens evt. fellesbrygger. To båter kan plasseres inntil hverandre. Båter må ikke plasseres nærmere grensen til nabostanden enn 0,5 m.

9. Arrangøren besørger renhold av gangareal. Renhold av stands og utstyr må besørges av utstiller.

10. Arrangøren besørger vanlig vakthold, men har intet ansvar for de utstilte båter og/eller andre produkter, verken før, under eller etter utstillingen. Den tid utstillingen er åpen for publikum, må alle båter være bemannet av utstiller. Utstiller må selv sørge for at det som utstilles er forsikret, herunder er forsikret for brann, skade og tyveri.

11. Utstiller plikter å vise forsiktighet for å forebygge ulykker og skader som kan tenkes å oppstå i forbindelse med deres deltagelse på utstillingen. Utstiller plikter også å behandle utstillingshallen og utstyr i denne med forsiktighet. Utstiller er erstatningsansvarlig overfor arrangør for skader og ulykker forårsaket av dem selv eller deres medkontrahenter.

12. Hel eller delvis fremleie, utlån eller overdragelse av utstillingsplass (stand) er ikke tillatt.

13. Alle båter og/eller andre produkter skal være tydelig priset med veiledende utsalgspriser, inklusive avgift(er).

14. Det er forbudt for utstiller:
a) å starte forbrenningsmotor i utstillingshallen.
b) å distribuere trykksaker m.v. utenfor sin egen stand.
c) å benytte brennbart stand- og reklamemateriale etc som ikke på forhånd er forskriftsmessig
brannimpregnert.
d) å benytte høyttalere eller andre apparater eller effekter som kan virke sjenerende eller forstyrrer andre utstillere eller publikum.

15. Uten skriftlig tillatelse fra arrangør er det forbudt:
a) å arrangere konkurranser, underholdning, oppvisning, film/videofremvisning eller annen visuell fremvisning, loddsalg, etc.
b) å fjerne båt(er) og/eller andre produkter fra utstillingen før denne er avsluttet.
c) å benytte lys- og andre bevegelige effekter.
d) å profilere/markedsføre andre produkter og varemerker på utstillingen enn båt, båtmotor, båtutstyr og/eller evt annet produkt som er særskilt godkjent av arrangøren, og som utstilleren og/eller forhandler(e) av denne fører.

16. Utstiller plikter å sørge for at utstilt(e) båt(er) og/eller andre produkter, standmateriell etc. fjernes (avhentes) fra utstillingsplassen senest innen kl. 15.00 den 2. dag etter utstillingens slutt. Alt vakthold blir da avsluttet. Dersom nevnte ikke er fjernet innen dette tidspunkt, plikter utstiller å betale til arrangøren kr. 2.000 pr. båt og/eller andre produkt(er) pr påbegynt døgn. Dette gjelder uansett om utstiller har solgt de(n) angjeldende båt(er) og/eller produkter til tredjemann. Arrangøren kan videre - for utstillers regning og risiko - fjerne og lagre båt(er) og/eller andre produkter, standmateriell etc, som ikke er avhentet innen nevnte tidspunkt, og - etter 14 dagers skriftlig varsel - avhende slik(e) for utstillers regning og risiko.

17. Utenlandske utstilleres kontaktpersoner i Norge er solidarisk ansvarlig med utstiller for at båt(er) og/eller andre produkter blir fjernet innen ovennevnte frister.

18. Dersom utstillingen hindres eller forsinkes av krig, streik, brann, lov- eller forskriftsendring, offentlig vedtak eller hendelse som uansett må regnes som force majeure, har arrangøren rett til å heve utstillingsavtalen uten at utstiller har krav på refusjon av innbetalt registreringsavgift, plassleie eller erstatning for annet tap som hevingen eller avlysningen måtte forårsake.

19. Arrangørens erstatningsansvar ved mislighold er i alle tilfelle begrenset til å maksimalt tilbakebetale innbetalt registreringsavgift og plassavgift.

20. Merverdiavgift på 25% vil bli lagt til på standleien. Søknadsskjema om Refusjon av norsk merverdiavgift til utenlandske næringsdrivende” finnes på våre nettsider.

 21. Mulige tvister mellom arrangør og utstiller løses etter norsk rett og med Oslo Tingrett som vedtatt verneting. I tilfelle av fortolkningstvist går den norske originaltekst foran oversettelse til andre språk.

Særskilt betingelse 2012
Priser for Sjøen for alle 2012 er angitt i invitasjonsbrosjyren/prislisten. Rabatten for Båter i sjøen 2012 forutsetter avholdt Sjøen for alle 2012 og Båter i sjøen 2012, og krav mot arrangøren kan ikke fremsettes, uavhengig om Båter i sjøen 2012 blir avholdt og eventuelt uavhengig av tidspunkt og sted dette måtte bli. Prisen for Båter i sjøen 2012 vil bli fastsatt i 2012, men rabatten er fast slik den fremgår av invitasjonsbrosjyren/prislisten.

EXHIBITION REGULATIONS – Sjøen for alle                                 English

1.The following products may be exhibited:

a)Boats with fittings and accessories.

 b) Boat engines with equipment, diving equipment, sport fishing tackle and other equipment for marine sports.

c) Information on maritime activities, holiday cruises, etc.

d) Other products in accordance with specific approval, by Organizer.

Non-Scandinavian exhibitors must have a responsible contact person in Norway.

2. The registration is binding. The Organizer may, at any time, up to 60 days prior to the opening of the exhibition, reject, wholly or partly booking(s) agreed or submitted, hereunder reject or refuse all or reduce the number of boat(s) and/or other products and services mentioned in Clause 1. The Organizer may also, after the stipulated time, and, as late as during the exhibition, make the above mentioned changes against compensating documented expenses of the Exhibitor. The Organizer is free to determine the distribution of the exhibition space. The boat(s) and/or products exhibited must comply with Norwegian laws and provisions, including regulations covering production and sale etc. of leisure boats (regulations covering CE-labelling) or legally binding judgement.

3. Furthermore, the Exhibitor must carefully, prior to, during and after the exhibition, at all times follow the established directions and instructions of the Organizer and the authorities.

4. If the registration fee and/or the exhibition fee is not paid by the stipulated date, or the Exhibitor cancels his booking, it is the responsibility of the Exhibitor to cover the registration fee and the exhibition fee, with the addition of interest and possible expenses. In such cases the Organizer is entitled to rent the space to others without further notice. If the Organizer succeeds in renting the space to another Exhibitor and the exhibition as such is fully booked, the Exhibitor is only obliged to cover the registration fee and 50 % of the exhibition fee. The Organizer has the right to exercise lien in the exhibited boat(s) and/or other products to cover non-payment of registration fee and/or exhibition fee.  Cancellation less than 14 days prior to the opening day – no refund.

5. The exhibition space will be made available to the Exhibitor at least 2 days prior to the opening.
The Exhibition Timetable will be forwarded to the Exhibitor well in advance, and must be strictly adhered to.

6. The Exhibitor must himself construct and furnish his stand (exhibition space), arrange all transport and ensure that the stand has been tidied up at the closing of the exhibition, all at his own expense. The Exhibitor is obliged to keep good order at his stand, and, at the Organisers request, improve conditions at his own expense, if the Organizer finds that the stands gives an unsatisfactory impression. Installation, connecting and utilisation of electric energy and telephone must be paid by the Exhibitor.

7. Any partition walls, maximum height 1.25 m. must be decorated on both sides, in cooperation with the adjacent stand, if possible. The height of decorations and posters shall not exceed 1.25 m. measured from the floor of the hall, unless written permission is obtained from the Organizer. In this case, a lay-out sketch must be submitted to the Organizer at least one month prior to the opening date of the exhibition. For wall spaces, 3 m. in depth, side walls with a height of up to 2.5 m. are permitted. The height of company signs must not exceed 50 cm. One such sign may be placed at each public entrance. The bottom edge of the sign shall be 2.40 m. above the floor of the hall. Against the permanent walls of the exhibition hall, additional walls may be erected up to 2.5 m. in height. Above this level, all use of walls, columns, balustrades, etc. of the hall, as well as suspended promotion material will incur a rental fee to be stipulated in each case by the Organizer and invoiced after the closing of the exhibition. Permission from the Organizer must be obtained in advance.

8. Stands on two levels, exceeding standard headroom of 2.5 m. must be approved in advance by the Organizer. In this case, layout sketch must be submitted to the Organizer at least two months before the opening date of the exhibition. For two-level stands, with a ground floor of at least 2.0 m. headroom, the Exhibitor will be charged with an additional 30% of the original stand fee for the actual floor space. If the top floor of a two level stand exceeds 20 m2. of floor- space, a sprinkler system (irrigation system) is compulsory, payable by the Exhibitor. Subject to special conditions,
a top floor covering less than 20 m2. may be permitted without a sprinkler system on the ground floor. For further details, contact the Organizer.

When boats are exhibited, there must be a passage around them of at least 1.0 m. except for boats located at any joint exhibition pier. Two boats may be placed together. Distance to the adjacent stand must be at least 0.5 m.

9. The Organizer will be responsible for the cleaning of public floor space. Cleaning of stands and equipment must be undertaken by the Exhibitor.

10. The Organizer will provide ordinary security services, but does is not responsible for the exhibited boat(s), neither prior to, during nor after the exhibition. During public opening hours, all stands must be manned by the staff of the Exhibitor.
It is the responsibility of the Exhibitor to arrange insurance coverage for the exhibited units, including fire, damage and theft.

11. It is the duty of the Exhibitor to take all possible care to prevent accidents and injuries that may arise in conjunction with his participation in the exhibition. It is, furthermore, the duty of the Exhibitor to use the exhibition area and the equipment placed herein with all possible care. The Exhibitor will be held liable by the Organizer for any accidents or damage caused by himself or his contracting parties.

12. Complete or partial sub-leasing, lending or transfer of the exhibition space (stand) is not permitted.

13. All boat(s) and/or other products must carry a visible label, indicating recommended price with all tax(es) included.

14. The Exhibitor will not be permitted to:
a) start combustion engines on the exhibition premises.
b) Distribute printed matter etc. outside his own stand.
c) Use inflammable stand- and promotion material which has not been adequately treated in advance, according to current regulations
d) Use loudspeakers or other equipment or devices having a nuisance effect, disturbing other exhibitors or the public.

15. Without the written consent of the Organizer it is not permitted to:
a) arrange competitions, entertainment, performances, movie or video shows or other visual screening, sell lottery tickets, etc.
b) to remove boat(s) and or other products from the exhibition before the closing date.
c) Use flashing lights or other moving devices.
d) To promote or market during the exhibition other products and brands than boats, boat engines, boat equipment and/or any other products specifically approved by the Organizer and/or stocked by the distributors.

16. It is the responsibility of the Exhibitor to undertake the relocation (removal) of exhibited boat(s) and/or other products not later than 15.00 hrs. on the second day after the closing of the exhibition. All security services will then be
discontinued. In case the above units have not been removed within this time, its the duty of the Exhibitor to pay to the Organizer NOK 2.000.- for each boat and/or product per day or part thereof. This applies irrespective of the boat(s) and/or products being sold to a third party by the Exhibitor. Furthermore, the Organizer might, for the account and risk of the Exhibitor, remove and store boat(s) and/or other products, stand material etc. which has not been collected
within the above mentioned time, and, with 14 days written notice, dispose of such unit(s) for the account and risk of the Exhibitor.

17. Contact persons in Norway representing foreign exhibitors are jointly and severally responsible together with the Exhibitor for the removal of boat(s) and/or other products within the time limits stipulated above.

18. In case the exhibition is obstructed or delayed because of war, strike, fire, amendments of laws and regulations, public resolutions or circumstances which, in any case, must be defined as “force majeure”, the Organizer has the right to cancel the exhibition agreement, without the Exhibitor being entitled to claim refund of prepaid registration fee, exhibition fee or compensation for any other loss caused by the actual termination or cancellation.

 19. The Organizer’s liability in case of breach of contract is at all times limited to a maximum refund of already paid registration fee and exhibition fee.

 20. VAT of 25% will be added.  VAT is refundable, and the refund process will be given by the NORBOAT administration.  You will all find “An application for refund of Norwegian Value Added Tax for foreign businesses” on our website.

21. Any feasible disputes between the Organizer and the Exhibitor, are to be settled according to Norwegian law and with the Oslo Town Court (Oslo tingrett) as legal venue. In case of interpretation disputes, the original Norwegian text shall take precedence over translations into other languages.

Special Term & Condition 2012
Prices for Sjøen for alle 2012 is specified in the invitation brochure/ price list.  The discount for Båter i sjøen 2012 assumes held Sjøen for alle 2012 and Båter i sjøen 2012, and claims against the organizer cannot be made, regardsless of Båter i Sjøen 2012 being held and independent of time and place.  Stand fee for Båter i sjøen 2012 will be set in 2012, but the discount is fixed as stated in the invitation brochure/ price list.
